Request for a reimbursement of my ticket funds.
INTRODUCTION
I am writing this letter to request a reimbursement of my ticket funds and luggage costs from your airline. I booked a first class flight from Miami,Florida to London three weeks ago and on checking in I was delayed for a whole hour and upon insistence was redirected to a flight that was leaving only thirty minutes later. I boarded the flight and unfortunately was shown an economy class seat. This was unacceptable and when I enquired from the flight crew I was informed that the business class section was full. When I landed in London, I was further surprised that my luggage was missing, and was informed that it had been left in Miami.
DEVELOPMENT
I was asked to write a formal letter of request to the Miami office with my ticket number attached in order to get my luggage back. I did and they responded that they had sent it on a flight by Fedex as part of other luggage. Upon arrival my luggage was nowhere to be found, and I have since been informed that I need to take up the luggage case with Fedex. The law is clear on such matters of consumer protection, and stipulate that a refund for a delay in flights arising from natural phenomena is not allowed, but the resulting downgrade in seats and flight conditions should necessitate a reimbursement. My luggage should also be protected by your airline under consumer protection laws during the time of the flight.
From an ethical perspective however, it does not matter whether FedEx is responsible for the lost luggage. The company itself also must have a terms and conditions document that is available during transactions for customers and this should point out its refusal to acknowledge the matter. Your airline cannot as a customer had logically engaged their services without giving a bother to any terms and conditions and yet they are transporting seemingly important cargo.
Legal Issues
There are two sides to this matter if I decide to pursue it legally. First, FedEx had an ethical obligation to take steps to protect its customers from theft since that is what gave them credibility as a business and brand. They are a company that is well known for transportation and theft of this nature looks very bad for their brand. They need to have a review of the situation and enquire from the people involved what really happened. They should have discussions with relevant stakeholders who can show them practical ways of dealing with the situation, these may include computer scientists and IT specialists. It is from these discussions that they will make an adequate decision on how to deal with the matter. They may decide to invest more in virtual security softwares or hire the services of an IT specialists who will look into the matter.
Second, the structure in organization of airlines in America is carried based on how much revenue the airline is making from its ventures. The airlines are further grouped into major, national or regional airlines. Every airline in the three aforementioned categories is required to have a certificate declaring their fitness and a valid operating certificate. The certificates are formally issued by The Department of Transportation. The certificates serve the purpose of ensuring that the airline has enough funds and management efficiency to carry out their operations. If I would decide to sue your airline, your certification would be at stake.
CONCLUSION
Yours is a major airline, making over $1 billion every year, your airline included. These airlines are usually in the business of providing worldwide services of travel and include American Eagle, Delta, Northwest, Continental and US Airways. It would not be a nice look for your airline to have such service issues on its hands. In terms of employee structure the airlines have line personnel who are the people involved with dealing with luggage. It is a wise place to ask if they have any information that may lead to its finding or have a reimbursement of the same.
